歲末年初,在各地加快申報第四批增量配電業務改革試點項目之際,國家發改委和國家能源局聯合下發了《關于進一步推進增量配電業務改革的通知》(發改經體〔2019〕27號),各方反響強烈。《通知》包括四部分,共三十條具體措施,為深入推進增量配電業務改革工作指明了方向。
筆者認為,通(tong)過多措并舉“打補丁”,完善升級增(zeng)量配電(dian)業務改(gai)革的頂層設計,推動改(gai)革落(luo)地是《通(tong)知》出臺的初衷;圍繞增(zeng)量放開(kai),著眼“進一步推進”,瞄(miao)準重(zhong)難點問題,靶(ba)向施策(ce)是貫(guan)穿全篇的主線(xian)。
前三批試點進展相對遲緩
2016年11月以來,國(guo)家發改委、國(guo)家能源局先(xian)后啟動了(le)3批(pi)(pi)(pi)320個(ge)(ge)(ge)增量配(pei)(pei)電業(ye)務(wu)改革(ge)試點,各地投資積極性很高。據(ju)了(le)解,截至2018年底,第(di)一批(pi)(pi)(pi)106個(ge)(ge)(ge)試點項(xiang)(xiang)(xiang)目(mu)全(quan)部(bu)或部(bu)分建(jian)(jian)成(cheng)33個(ge)(ge)(ge),在建(jian)(jian)項(xiang)(xiang)(xiang)目(mu)12個(ge)(ge)(ge),開(kai)展(zhan)前期工作項(xiang)(xiang)(xiang)目(mu)50個(ge)(ge)(ge),取(qu)得(de)(de)(de)電力業(ye)務(wu)許可證40個(ge)(ge)(ge);第(di)二批(pi)(pi)(pi)89個(ge)(ge)(ge)試點項(xiang)(xiang)(xiang)目(mu)中全(quan)部(bu)或部(bu)分建(jian)(jian)成(cheng)項(xiang)(xiang)(xiang)目(mu)10個(ge)(ge)(ge),在建(jian)(jian)項(xiang)(xiang)(xiang)目(mu)4個(ge)(ge)(ge),開(kai)展(zhan)前期工作項(xiang)(xiang)(xiang)目(mu)41個(ge)(ge)(ge),取(qu)得(de)(de)(de)電力業(ye)務(wu)許可證7個(ge)(ge)(ge);第(di)三批(pi)(pi)(pi)125個(ge)(ge)(ge)試點項(xiang)(xiang)(xiang)目(mu)中全(quan)部(bu)或部(bu)分建(jian)(jian)成(cheng)項(xiang)(xiang)(xiang)目(mu)5個(ge)(ge)(ge),在建(jian)(jian)項(xiang)(xiang)(xiang)目(mu)1個(ge)(ge)(ge),開(kai)展(zhan)前期工作項(xiang)(xiang)(xiang)目(mu)24個(ge)(ge)(ge),取(qu)得(de)(de)(de)電力業(ye)務(wu)許可證2個(ge)(ge)(ge)。總體來看(kan),增量配(pei)(pei)電業(ye)務(wu)試點進展(zhan)相對緩(huan)慢(man),投產(chan)運行項(xiang)(xiang)(xiang)目(mu)偏少。
試(shi)點(dian)(dian)推(tui)動工作(zuo)高(gao)(gao)頻次開展(zhan)。近(jin)半年(nian)來,國(guo)家層(ceng)面(mian)開展(zhan)了一系(xi)列工作(zuo),加快(kuai)推(tui)動試(shi)點(dian)(dian)項目(mu)(mu)落地見效(xiao)。2018年(nian)8月(yue),國(guo)家發(fa)改(gai)委(wei)(wei)和國(guo)家能源局組成6個(ge)督導調(diao)研(yan)組,分(fen)赴14個(ge)省(sheng)(sheng)(區、市)調(diao)研(yan);2018年(nian)10月(yue)9日(ri),國(guo)家發(fa)改(gai)委(wei)(wei)和國(guo)家能源局印發(fa)《關(guan)于(yu)增量(liang)配電(dian)業務改(gai)革第(di)一批(pi)試(shi)點(dian)(dian)項目(mu)(mu)進展(zhan)情況的通報》(發(fa)改(gai)經(jing)體(ti)〔2018〕1460號(hao)),重點(dian)(dian)通報了進展(zhan)緩慢和問題突出(chu)的試(shi)點(dian)(dian)項目(mu)(mu),并明確要(yao)求第(di)一批(pi)試(shi)點(dian)(dian)項目(mu)(mu)應(ying)于(yu)2019年(nian)6月(yue)底前建(jian)成投運。2018年(nian)10月(yue)11日(ri),國(guo)家發(fa)改(gai)委(wei)(wei)會(hui)同(tong)國(guo)家能源局約談了遼寧、浙江、江西、山東、河南、四川省(sheng)(sheng)相關(guan)部(bu)門和省(sheng)(sheng)級電(dian)網(wang)公(gong)(gong)司(si)(si),明確要(yao)求地方政府相關(guan)部(bu)門要(yao)切(qie)實(shi)履行職責,加強(qiang)協調(diao)推(tui)動,電(dian)網(wang)公(gong)(gong)司(si)(si)要(yao)提高(gao)(gao)站位(wei),加大力(li)度(du)支(zhi)持增量(liang)配電(dian)改(gai)革工作(zuo)。2018年(nian)11月(yue)22日(ri),國(guo)家發(fa)改(gai)委(wei)(wei)辦公(gong)(gong)廳(ting)、國(guo)家能源局綜合司(si)(si)印發(fa)《關(guan)于(yu)建(jian)立增量(liang)配電(dian)業務改(gai)革試(shi)點(dian)(dian)項目(mu)(mu)直(zhi)接聯系(xi)制(zhi)度(du)的通知》(發(fa)改(gai)辦經(jing)體(ti)〔2018〕1492號(hao)),選(xuan)取12個(ge)試(shi)點(dian)(dian)項目(mu)(mu)作(zuo)為直(zhi)接聯系(xi)點(dian)(dian),要(yao)求各(ge)有關(guan)司(si)(si)局點(dian)(dian)對點(dian)(dian)加強(qiang)指導協調(diao),推(tui)動試(shi)點(dian)(dian)項目(mu)(mu)盡快(kuai)落地運行。
針對增量配(pei)電業(ye)務存在(zai)的實際難題,國家發改委和國家能源(yuan)局于2018年上(shang)半年開始組織編制《通知》,從初稿(gao)征求意(yi)見到正式出臺(tai)歷時(shi)近一年。
《通知》折射出多項深層次矛盾
從各(ge)方(fang)反(fan)應和實際情(qing)況看,增量配電業務改革在推進過程中主要(yao)存在以下(xia)問題:
一(yi)是業(ye)(ye)主(zhu)招標不規(gui)范,公平競爭(zheng)要求未有效(xiao)落實。《有序放開配電網業(ye)(ye)務管(guan)理辦法》(發(fa)改(gai)經體〔2016〕2120號)明(ming)確(que)(que)要求,通過市(shi)場競爭(zheng)確(que)(que)定投資(zi)主(zhu)體;國家發(fa)改(gai)委、國家能源(yuan)局(ju)在批復試(shi)點(dian)項目時,對此又做了多(duo)次強(qiang)調(diao)。但在實際操作中(zhong),部分(fen)地方政府在試(shi)點(dian)項目的(de)招標環節設置前置條件,人為干預招標結(jie)果,電網企(qi)業(ye)(ye)則強(qiang)行(xing)要求控(kong)股,阻礙社會資(zi)本進(jin)入,導致目前已確(que)(que)定業(ye)(ye)主(zhu)的(de)項目中(zhong),很大一(yi)部分(fen)由電網企(qi)業(ye)(ye)或地方政府投資(zi)平臺(tai)控(kong)股,社會資(zi)本參(can)與試(shi)點(dian)項目積極性(xing)受到嚴重影響(xiang)。
二是部分(fen)項目涉(she)及的(de)電(dian)網存(cun)量(liang)(liang)(liang)資(zi)產(chan)處置困難。對于涉(she)及電(dian)網企業存(cun)量(liang)(liang)(liang)資(zi)產(chan)的(de)項目,《增量(liang)(liang)(liang)配(pei)(pei)電(dian)業務配(pei)(pei)電(dian)區域劃分(fen)實(shi)施辦法(試行)》(發改能(neng)源規〔2018〕424號)明(ming)確了入股、出售、產(chan)權置換、租(zu)賃(lin)等4種處置方(fang)式。但在實(shi)際操作中,由(you)于資(zi)產(chan)管理體制和模(mo)式、決策(ce)責任、觀念(nian)認識(shi)、處置標準等因素的(de)交織影響,導(dao)致存(cun)量(liang)(liang)(liang)資(zi)產(chan)處置裹足不前(qian),增量(liang)(liang)(liang)存(cun)量(liang)(liang)(liang)融合發展(zhan)的(de)活(huo)力難以釋放。
三是配(pei)電(dian)區(qu)域(yu)劃(hua)分(fen)(fen)困難。據反映,一些試(shi)(shi)點項(xiang)(xiang)目(mu)在劃(hua)分(fen)(fen)配(pei)電(dian)區(qu)域(yu)時,存(cun)在借避免重復建設(she)(she)、交叉供電(dian)為(wei)由(you),壓(ya)縮試(shi)(shi)點項(xiang)(xiang)目(mu)范(fan)圍“以小代大”的(de)情況,還存(cun)在將控股(gu)參(can)股(gu)項(xiang)(xiang)目(mu)與(yu)配(pei)電(dian)區(qu)域(yu)劃(hua)分(fen)(fen)互為(wei)前提(ti)的(de)情況。個別(bie)地(di)方有搶建試(shi)(shi)點區(qu)域(yu)內增量配(pei)電(dian)設(she)(she)施、擠壓(ya)增量配(pei)電(dian)業(ye)務試(shi)(shi)點范(fan)圍的(de)現(xian)象。
四是(shi)對增量配(pei)(pei)電(dian)(dian)網(wang)(wang)規(gui)(gui)劃(hua)(hua)(hua)不重視(shi),規(gui)(gui)劃(hua)(hua)(hua)工作流于形式。不少(shao)地(di)方(fang)政府或項目業主在推(tui)進(jin)試點(dian)的(de)過程中,存在重股權爭奪(duo)、重負荷爭奪(duo)、輕電(dian)(dian)網(wang)(wang)規(gui)(gui)劃(hua)(hua)(hua)的(de)現(xian)象,相關(guan)電(dian)(dian)網(wang)(wang)規(gui)(gui)劃(hua)(hua)(hua)工作不能(neng)滿足項目推(tui)進(jin)的(de)要(yao)求,導致項目在后續(xu)推(tui)進(jin)中,在存量資產處置、配(pei)(pei)電(dian)(dian)區域(yu)劃(hua)(hua)(hua)分、系統接入等方(fang)面困(kun)難重重。一(yi)方(fang)面,這(zhe)是(shi)因為各方(fang)對規(gui)(gui)劃(hua)(hua)(hua)工作的(de)重要(yao)性認識(shi)不夠;另一(yi)方(fang)面,也是(shi)因為從國家層面到(dao)地(di)方(fang)層面都沒有對增量配(pei)(pei)電(dian)(dian)網(wang)(wang)規(gui)(gui)劃(hua)(hua)(hua)出臺(tai)相關(guan)的(de)規(gui)(gui)范規(gui)(gui)定。
五是項(xiang)(xiang)(xiang)目(mu)(mu)(mu)接入電(dian)(dian)(dian)網(wang)環節(jie)的(de)機制和流程不明確,不利于(yu)試(shi)點項(xiang)(xiang)(xiang)目(mu)(mu)(mu)盡早(zao)投運和電(dian)(dian)(dian)網(wang)互聯(lian)互通。由于(yu)電(dian)(dian)(dian)網(wang)企業(ye)對(dui)未控股、參股項(xiang)(xiang)(xiang)目(mu)(mu)(mu)進行信息封鎖,導致增量(liang)配電(dian)(dian)(dian)項(xiang)(xiang)(xiang)目(mu)(mu)(mu)業(ye)主難以獲(huo)取接入系(xi)統所必(bi)備的(de)電(dian)(dian)(dian)網(wang)信息,無法開展配電(dian)(dian)(dian)網(wang)接入系(xi)統規劃設計;在部(bu)分試(shi)點項(xiang)(xiang)(xiang)目(mu)(mu)(mu)中,電(dian)(dian)(dian)網(wang)企業(ye)未能(neng)(neng)及(ji)時(shi)提(ti)供(gong)增量(liang)配電(dian)(dian)(dian)項(xiang)(xiang)(xiang)目(mu)(mu)(mu)并網(wang)服務,導致部(bu)分已開工項(xiang)(xiang)(xiang)目(mu)(mu)(mu)停滯或部(bu)分已建成(cheng)的(de)配電(dian)(dian)(dian)設施難以開展供(gong)電(dian)(dian)(dian)業(ye)務;甚(shen)至有部(bu)分試(shi)點項(xiang)(xiang)(xiang)目(mu)(mu)(mu)因為和電(dian)(dian)(dian)網(wang)企業(ye)存在分歧,未能(neng)(neng)從大(da)電(dian)(dian)(dian)網(wang)獲(huo)取施工電(dian)(dian)(dian)源。
六是試(shi)(shi)點(dian)項目(mu)(mu)(mu)實際情(qing)況與申報(bao)時差距(ju)明顯(xian),導致社會資(zi)本投資(zi)積(ji)極性受挫。部分(fen)試(shi)(shi)點(dian)項目(mu)(mu)(mu)在上報(bao)過程(cheng)中甄選不嚴格,缺乏可行性論證,對用(yong)電增長(chang)的判斷盲目(mu)(mu)(mu)樂觀。試(shi)(shi)點(dian)項目(mu)(mu)(mu)開始推進(jin)后,受經(jing)濟增速放緩等因素(su)影響(xiang),部分(fen)園區(qu)(qu)引(yin)進(jin)投資(zi)情(qing)況不理想,試(shi)(shi)點(dian)區(qu)(qu)域(yu)實際用(yong)電增長(chang)遠低于(yu)預期。部分(fen)試(shi)(shi)點(dian)項目(mu)(mu)(mu)供(gong)電區(qu)(qu)域(yu)內產(chan)業規劃仍未確定,短期內能否形(xing)成有效用(yong)電需求尚無從判斷,項目(mu)(mu)(mu)建(jian)設的必(bi)要性存疑。
首次對試點項目業主構成亮明態度
《通知》第(di)一(yi)部分重點對(dui)進一(yi)步規(gui)范(fan)項目業主確定提出要求,可(ke)以概括為“兩個不(bu)建議(yi),一(yi)個可(ke)維持”。
“兩個不建(jian)議(yi)”即(ji)“不建(jian)議(yi)電(dian)(dian)網企業(ye)或(huo)當(dang)地地方政府投資(zi)(zi)平臺控(kong)股(gu)試(shi)點(dian)(dian)項目(mu)”,為社(she)會資(zi)(zi)本參(can)與進一(yi)步預留(liu)空間。這(zhe)(zhe)也(ye)是政策層(ceng)面第一(yi)次明確表達對增(zeng)量配(pei)電(dian)(dian)試(shi)點(dian)(dian)項目(mu)業(ye)主構成的(de)鮮(xian)明態度,對第二批、第三批乃(nai)至正(zheng)在申報的(de)第四批試(shi)點(dian)(dian)項目(mu)提出了(le)明確的(de)要求。“一(yi)個可維(wei)(wei)持”即(ji)“已確定業(ye)主的(de)試(shi)點(dian)(dian)項目(mu)可維(wei)(wei)持項目(mu)各投資(zi)(zi)方股(gu)比不變”,這(zhe)(zhe)又為已確定業(ye)主項目(mu)的(de)股(gu)權結構穩定吃(chi)了(le)“定心丸”。
試(shi)點批復(fu)以來,社(she)會各方對(dui)(dui)電網企業(ye)不得(de)控股試(shi)點項目的(de)呼聲(sheng)很高(gao),認為電網企業(ye)控股或將導(dao)致增量配電網業(ye)務放(fang)開意義(yi)弱化、項目管理(li)因襲傳統電網體制、進展遲緩(huan)、社(she)會資(zi)本(ben)積極(ji)性(xing)不高(gao)等情況。此(ci)次明確不建議電網企業(ye)控股試(shi)點項目,既(ji)是對(dui)(dui)電網企業(ye)的(de)不對(dui)(dui)稱監管,也是對(dui)(dui)社(she)會資(zi)本(ben)的(de)支持。
地(di)方(fang)(fang)政(zheng)(zheng)府投(tou)資平(ping)臺控(kong)股的(de)試(shi)點項(xiang)目在已(yi)確(que)定(ding)業(ye)主的(de)試(shi)點項(xiang)目中屢見(jian)不鮮。從(cong)積極的(de)角度說,地(di)方(fang)(fang)政(zheng)(zheng)府投(tou)資平(ping)臺控(kong)股的(de)項(xiang)目在與(yu)電網企業(ye)博(bo)弈、項(xiang)目核準建設等(deng)方(fang)(fang)面易(yi)于(yu)獲得地(di)方(fang)(fang)政(zheng)(zheng)府的(de)支(zhi)持,促(cu)進項(xiang)目的(de)落地(di)。但也要看到,地(di)方(fang)(fang)投(tou)資平(ping)臺參與(yu)易(yi)于(yu)造成國(guo)資控(kong)股主導、民資進入困難、投(tou)資沖動(dong)強(qiang)、運營效(xiao)率(lv)低、利用(yong)行政(zheng)(zheng)手段降(jiang)低電價(jia)、片面追(zhui)求招商引資效(xiao)應等(deng)問題(ti)。
總之,從《通知》的(de)要求(qiu)可以(yi)看出,國家(jia)層面希望的(de)試點(dian)項目業(ye)主,應將股權多元化與完善企(qi)業(ye)法人治理結構相結合,國資、民(min)資相互監督制衡、取長(chang)補短(duan),實(shi)現混(hun)合所有制改(gai)革和增量配電改(gai)革協調推進(jin)。
進一步界定了增量和存量范疇
《通(tong)知(zhi)》第二部分對哪些資(zi)(zi)產屬(shu)于(yu)(yu)存量(liang)配(pei)(pei)(pei)電設(she)(she)(she)施(shi),哪些可納入增(zeng)量(liang)配(pei)(pei)(pei)電設(she)(she)(she)施(shi)進(jin)行了明確。例如,《通(tong)知(zhi)》提出,“尚(shang)未核準(zhun)(zhun)或(huo)備(bei)案(an)的(de)配(pei)(pei)(pei)電網(wang)(wang)項(xiang)(xiang)(xiang)(xiang)目屬(shu)于(yu)(yu)增(zeng)量(liang)配(pei)(pei)(pei)電業務范圍(wei)”,這實際(ji)是在(zai)(zai)明確,電網(wang)(wang)公司內部規劃的(de)配(pei)(pei)(pei)電網(wang)(wang)項(xiang)(xiang)(xiang)(xiang)目,不屬(shu)于(yu)(yu)電網(wang)(wang)公司存量(liang)資(zi)(zi)產。“已獲(huo)核準(zhun)(zhun)或(huo)備(bei)案(an)、但在(zai)(zai)相關(guan)(guan)文件(jian)有效期(qi)內未開工建(jian)(jian)設(she)(she)(she)的(de)配(pei)(pei)(pei)電網(wang)(wang)項(xiang)(xiang)(xiang)(xiang)目均(jun)屬(shu)于(yu)(yu)增(zeng)量(liang)配(pei)(pei)(pei)電業務范圍(wei)”等(deng)要(yao)求(qiu)(qiu),則(ze)是對電網(wang)(wang)公司建(jian)(jian)設(she)(she)(she)進(jin)度的(de)要(yao)求(qiu)(qiu)。長期(qi)以(yi)來,各(ge)地工業園(yuan)區(qu)對電網(wang)(wang)企業的(de)詬病主要(yao)存在(zai)(zai)與電網(wang)(wang)投資(zi)(zi)決策程序慢,建(jian)(jian)設(she)(she)(she)進(jin)度無法滿(man)足園(yuan)區(qu)用電需求(qiu)(qiu)。今后(hou),拖延建(jian)(jian)設(she)(she)(she)的(de)配(pei)(pei)(pei)電網(wang)(wang)項(xiang)(xiang)(xiang)(xiang)目將從電網(wang)(wang)公司的(de)手中拿出來,交給增(zeng)量(liang)配(pei)(pei)(pei)電項(xiang)(xiang)(xiang)(xiang)目業主運作(zuo)。《通(tong)知(zhi)》中對違(wei)規建(jian)(jian)設(she)(she)(she)的(de)相關(guan)(guan)要(yao)求(qiu)(qiu),則(ze)是對目前存在(zai)(zai)的(de)電網(wang)(wang)企業在(zai)(zai)試點區(qu)域內搶建(jian)(jian)配(pei)(pei)(pei)電設(she)(she)(she)施(shi)的(de)現象的(de)回應。
產(chan)(chan)權(quan)制度是社會主義市場經(jing)濟的(de)基石,保(bao)護產(chan)(chan)權(quan)是堅持社會主義基本經(jing)濟制度的(de)必然要求。《通知(zhi)》第(七)條則是按照產(chan)(chan)權(quan)保(bao)護的(de)要求,對由于歷史原因(yin),地方或用(yong)戶無(wu)償(chang)(chang)移(yi)交(jiao)給電(dian)(dian)網(wang)企(qi)業(ye)運(yun)營的(de)配(pei)電(dian)(dian)設(she)施(shi)的(de)產(chan)(chan)權(quan)進行了明確(que)。據了解,部(bu)分電(dian)(dian)網(wang)企(qi)業(ye)曾認為(wei),地方或用(yong)戶無(wu)償(chang)(chang)移(yi)交(jiao)給電(dian)(dian)網(wang)企(qi)業(ye)的(de)配(pei)電(dian)(dian)設(she)施(shi)長期(qi)以來由電(dian)(dian)網(wang)公司(si)運(yun)營,所以必然屬于電(dian)(dian)網(wang)企(qi)業(ye)存量資產(chan)(chan)。因(yin)此,第(七)條的(de)關(guan)鍵(jian)詞是“資產(chan)(chan)權(quan)”和“依(yi)法”,運(yun)營權(quan)和使(shi)用(yong)權(quan)并不(bu)能作為(wei)資產(chan)(chan)劃分的(de)依(yi)據。
《有序(xu)放(fang)開配(pei)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)網(wang)業務(wu)管理辦(ban)法》曾明確(que):“配(pei)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)網(wang)原則(ze)上指(zhi)110千伏(fu)及以下(xia)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)壓(ya)等(deng)級(ji)(ji)(ji)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)網(wang)和220(330)千伏(fu)及以下(xia)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)壓(ya)等(deng)級(ji)(ji)(ji)工業園區(經濟(ji)開發(fa)區)等(deng)局域電(dian)(dian)(dian)(dian)(dian)(dian)(dian)網(wang)。”但在(zai)實際(ji)工作中,各方對(dui)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)壓(ya)等(deng)級(ji)(ji)(ji)一直存在(zai)爭議。部(bu)分電(dian)(dian)(dian)(dian)(dian)(dian)(dian)網(wang)企業認為,220(330)千伏(fu)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)壓(ya)等(deng)級(ji)(ji)(ji)屬(shu)于(yu)輸電(dian)(dian)(dian)(dian)(dian)(dian)(dian)網(wang),不應納(na)入(ru)增量配(pei)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)業務(wu)改(gai)革試(shi)點。此次《通知(zhi)》第(八)條不僅明確(que)了僅具備(bei)配(pei)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)功能(neng)(neng)的(de)220(330)千伏(fu)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)壓(ya)等(deng)級(ji)(ji)(ji)可以納(na)入(ru)增量配(pei)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)業務(wu)改(gai)革試(shi)點,還(huan)明確(que)了“可不限于(yu)用戶專用變(bian)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)站和終端(duan)變(bian)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)站”。這就為一些配(pei)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)區域大、園區負荷高、用戶電(dian)(dian)(dian)(dian)(dian)(dian)(dian)壓(ya)等(deng)級(ji)(ji)(ji)需要達到220(330)千伏(fu)的(de)試(shi)點項目指(zhi)明了方向,使其可以在(zai)園區內建立僅具備(bei)配(pei)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)功能(neng)(neng)的(de)220千伏(fu)環(huan)網(wang),滿(man)足園區多家(jia)高耗(hao)能(neng)(neng)企業的(de)用電(dian)(dian)(dian)(dian)(dian)(dian)(dian)需求。
進一步構建了規劃體系
《通(tong)知》第三部(bu)分從規劃職能(neng)、邊界條件、信息獲取、編制深(shen)度、評審要求、后續銜(xian)接(jie)等方面提出要求,對增量(liang)(liang)配電網規劃體系的建設和運行明確(que)了(le)政(zheng)策導向,是開展增量(liang)(liang)配電網規劃工作的行動指南。
明確了規劃工(gong)(gong)作(zuo)責任主體是地方能源(yuan)主管(guan)部門。大(da)部分(fen)增(zeng)量配電(dian)業務試點項目(mu)都有潛(qian)(qian)在業主在前期階段做技術支持。增(zeng)量配電(dian)業務改革(ge)推(tui)進的過程(cheng)中,存在潛(qian)(qian)在業主代替政府部門委托第三方咨詢(xun)機構開展規劃工(gong)(gong)作(zuo)的情況。
政府部門為電(dian)力(li)(li)(li)規(gui)(gui)劃(hua)(hua)的責任(ren)主(zhu)體,電(dian)力(li)(li)(li)企業提出規(gui)(gui)劃(hua)(hua)建議,是(shi)《電(dian)力(li)(li)(li)規(gui)(gui)劃(hua)(hua)管理(li)辦法(fa)》(國能電(dian)力(li)(li)(li)〔2016〕139號)的重要(yao)內容(rong)。為了便于條(tiao)文制定,僅在文件中明(ming)確了省級(ji)及以上電(dian)力(li)(li)(li)規(gui)(gui)劃(hua)(hua)的責任(ren)部門。政府主(zhu)導電(dian)力(li)(li)(li)規(gui)(gui)劃(hua)(hua)從制度(du)上保障(zhang)了規(gui)(gui)劃(hua)(hua)以全社會視角來開展,確保了電(dian)力(li)(li)(li)規(gui)(gui)劃(hua)(hua)的公正、客(ke)觀(guan)和科學性。
《通知》進一步(bu)明確了增(zeng)量配(pei)電網規劃(hua)工作的責任主體是地方能源(yuan)主管部門,園區(qu)管委會或區(qu)縣政府可(ke)以代為(wei)履行(xing),避(bi)免增(zeng)量配(pei)電網規劃(hua)編制工作受委托主體的利(li)益影響造成(cheng)規劃(hua)成(cheng)果的偏差。同時,規劃(hua)責任主體也要(yao)充分征(zheng)求(qiu)、吸納(na)相關方的合理化建議。
進(jin)一步明確了(le)規(gui)(gui)劃(hua)的(de)邊(bian)界(jie)條(tiao)件。政(zheng)策要(yao)求(qiu)、規(gui)(gui)劃(hua)范圍、市政(zheng)規(gui)(gui)劃(hua)和(he)相(xiang)(xiang)關電(dian)(dian)力(li)系(xi)統現狀(zhuang)及規(gui)(gui)劃(hua)是增量配電(dian)(dian)網(wang)規(gui)(gui)劃(hua)主要(yao)的(de)邊(bian)界(jie)條(tiao)件。增量配電(dian)(dian)業務改革推進(jin)的(de)過程中,存(cun)在依(yi)托(tuo)常規(gui)(gui)機組建(jian)局域網(wang)等違反政(zheng)策要(yao)求(qiu)情況,存(cun)在規(gui)(gui)劃(hua)范圍過小或過大的(de)情況,存(cun)在規(gui)(gui)劃(hua)編制單(dan)位(wei)對相(xiang)(xiang)關電(dian)(dian)力(li)系(xi)統現狀(zhuang)及規(gui)(gui)劃(hua)了(le)解不足(zu)的(de)情況。
依(yi)托(tuo)常規機(ji)組建局域網,對于單(dan)(dan)個試點項目(mu)(mu)獲取了(le)低廉的(de)(de)(de)電價,但(dan)從全社會角度來看削弱了(le)電網互(hu)聯帶來的(de)(de)(de)電力系統效(xiao)(xiao)率和可(ke)靠性(xing)的(de)(de)(de)提(ti)升,同(tong)時與(yu)其他(ta)工業園區(qu)(經濟技(ji)術開(kai)(kai)發(fa)區(qu))形成(cheng)(cheng)了(le)不(bu)(bu)公平競爭。規劃(hua)(hua)范(fan)圍過小,造(zao)成(cheng)(cheng)在規劃(hua)(hua)階段存量與(yu)增量總(zong)體情(qing)況摸不(bu)(bu)清,制(zhi)約了(le)規劃(hua)(hua)的(de)(de)(de)科學性(xing);規劃(hua)(hua)范(fan)圍過大,不(bu)(bu)利于后(hou)續工作(zuo)的(de)(de)(de)開(kai)(kai)展。規劃(hua)(hua)編制(zhi)單(dan)(dan)位對相關電力系統了(le)解不(bu)(bu)足,造(zao)成(cheng)(cheng)增量配電網與(yu)上級電網、周邊(bian)電網不(bu)(bu)能有效(xiao)(xiao)銜接,造(zao)成(cheng)(cheng)試點項目(mu)(mu)無法(fa)有效(xiao)(xiao)落地。
《通知》進一步(bu)明確了(le)政策不(bu)允(yun)許(xu)(xu)的(de)增量配電(dian)網建(jian)設(she)方式,不(bu)允(yun)許(xu)(xu)利(li)(li)用常(chang)規機(ji)組和(he)(he)自備機(ji)組搞不(bu)公平(ping)競(jing)爭,但(dan)允(yun)許(xu)(xu)符合政策且納入(ru)規劃的(de)分布式電(dian)源就近(jin)接(jie)入(ru),提(ti)高試(shi)點項(xiang)目經濟效益;進一步(bu)明確了(le)園區類(lei)試(shi)點項(xiang)目的(de)規劃范(fan)圍原則上按(an)土(tu)地利(li)(li)用規劃和(he)(he)城鄉建(jian)設(she)規劃等上位(wei)規劃確定,以期規劃范(fan)圍有(you)利(li)(li)于(yu)存(cun)量與增量的(de)統籌;進一步(bu)明確了(le)規劃編制單(dan)位(wei)獲取(qu)相關電(dian)力系統現況及規劃的(de)渠道,電(dian)網企業有(you)義務在規定的(de)時間(jian)內向(xiang)電(dian)力規劃責任主體提(ti)供(gong)資料,并由(you)電(dian)力規劃責任主體轉給(gei)規劃編制單(dan)位(wei)。
進一(yi)步提(ti)出了規(gui)劃(hua)(hua)內容的深度要求(qiu)。從全社(she)會(hui)的視角來看,增(zeng)量配(pei)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)網(wang)和(he)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)網(wang)企(qi)業的公共電(dian)(dian)(dian)(dian)(dian)(dian)(dian)網(wang)均為滿(man)足電(dian)(dian)(dian)(dian)(dian)(dian)(dian)力需求(qiu)的基礎設施。增(zeng)量配(pei)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)業務(wu)改革(ge)推進過(guo)程中(zhong),存在增(zeng)量配(pei)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)網(wang)新建(jian)變(bian)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)站與容量尚未(wei)有效利用的變(bian)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)站距離(li)較近甚(shen)至相鄰而建(jian)的情(qing)況。上述情(qing)況很(hen)可能造成配(pei)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)網(wang)無序(xu)發展和(he)重復建(jian)設,易(yi)于(yu)造成公共資源浪費和(he)全社(she)會(hui)成本(ben)抬升。通過(guo)規(gui)劃(hua)(hua)階段(duan)的統籌謀(mou)劃(hua)(hua)和(he)科學安排,采取調整變(bian)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)站選址和(he)建(jian)設時序(xu)等規(gui)劃(hua)(hua)手段(duan),避免不利情(qing)況發生(sheng),是規(gui)劃(hua)(hua)工作的題中(zhong)應有之意(yi)。
《通知》提出增量配(pei)電(dian)(dian)網規(gui)劃(hua)編(bian)制階段要(yao)視(shi)實際需要(yao)設置(zhi)重復辨識環節(jie),并以專門章節(jie)的形式(shi)在規(gui)劃(hua)方案(an)中體現(xian)(xian),是對傳統配(pei)電(dian)(dian)網規(gui)劃(hua)深度(du)的調(diao)整和突破,適應現(xian)(xian)實需要(yao),體現(xian)(xian)了增量配(pei)電(dian)(dian)網的特點(dian)。
進(jin)一步提出了規劃(hua)評(ping)審(shen)階(jie)段(duan)的(de)(de)組(zu)織(zhi)要(yao)求。增(zeng)量(liang)配電(dian)網規劃(hua)評(ping)審(shen)工(gong)作(zuo)是(shi)把(ba)控增(zeng)量(liang)配電(dian)網規劃(hua)質(zhi)量(liang),為后續工(gong)作(zuo)打(da)牢(lao)基礎的(de)(de)重要(yao)環(huan)節。增(zeng)量(liang)配電(dian)業(ye)務改革推進(jin)過(guo)程(cheng)中(zhong),部分項目評(ping)審(shen)工(gong)作(zuo)在組(zu)織(zhi)形式(shi)和(he)內容(rong)流程(cheng)上存(cun)在不規范、流于形式(shi)的(de)(de)情況(kuang),甚(shen)至(zhi)存(cun)在由規劃(hua)編制(zhi)單位、電(dian)網企業(ye)或其他潛在業(ye)主利益相(xiang)關方直接(jie)擔任評(ping)審(shen)專(zhuan)家(jia)的(de)(de)情況(kuang)。上述情況(kuang)下,就會滋生“屁股決定腦袋”“打(da)招呼”等現(xian)象,不僅妨害評(ping)審(shen)主體的(de)(de)中(zhong)立(li)性(xing),還會導致評(ping)審(shen)結論科學性(xing)和(he)有效(xiao)性(xing)無(wu)法保障、評(ping)審(shen)流程(cheng)的(de)(de)公(gong)正性(xing)受(shou)到妨害的(de)(de)情況(kuang)。
《通知》進一步提出了增量配電(dian)網(wang)(wang)規劃評(ping)審工(gong)作(zuo)由省級能源主管部門組織,委(wei)托具有資質的(de)第三方咨詢機構開展,要求利益攸關方不(bu)得擔(dan)任(ren)評(ping)審專家(jia),同時認真聽取政(zheng)府(fu)部門、電(dian)網(wang)(wang)企業及(ji)其他(ta)潛業主的(de)意見,從制度(du)上(shang)避免了上(shang)述情況的(de)發生。
進一步明確了規(gui)(gui)劃(hua)銜接(jie)的后續工(gong)作要求。配電區域(yu)劃(hua)分和增(zeng)量(liang)配電網(wang)接(jie)入系統(tong)設計是與規(gui)(gui)劃(hua)直(zhi)接(jie)相關的后續工(gong)作。增(zeng)量(liang)配電業務改革(ge)推進過(guo)程中,這兩項具體(ti)工(gong)作相對(dui)用時(shi)較長。
增量(liang)配(pei)電(dian)業務改(gai)革試點(dian)(dian)項(xiang)目推進有(you)項(xiang)目規劃(hua)(hua)(hua)、業主(zhu)確定(ding)、項(xiang)目核(he)準、項(xiang)目建設(she)、公網接入、價格核(he)定(ding)、許可申請和配(pei)電(dian)運營多個步驟,具體的順序和操作過程在(zai)(zai)實施上各(ge)地會有(you)所差(cha)異。配(pei)電(dian)區域劃(hua)(hua)(hua)分(fen)可以在(zai)(zai)項(xiang)目規劃(hua)(hua)(hua)階段劃(hua)(hua)(hua)分(fen),也可以在(zai)(zai)業主(zhu)確定(ding)后劃(hua)(hua)(hua)分(fen)。增量(liang)配(pei)電(dian)網接入系統設(she)計是(shi)在(zai)(zai)項(xiang)目核(he)準之前完成(cheng)。這兩項(xiang)工作是(shi)后續工作的基礎(chu),是(shi)推動試點(dian)(dian)項(xiang)目的重點(dian)(dian)和難點(dian)(dian)問題。
《通知(zhi)》進(jin)一(yi)步明確(que)了配(pei)(pei)電(dian)區(qu)域(yu)劃分按照《增(zeng)量(liang)配(pei)(pei)電(dian)業(ye)(ye)務配(pei)(pei)電(dian)區(qu)域(yu)劃分實施(shi)辦法(試(shi)行(xing))》(發(fa)改能源(yuan)規〔2018〕424號)確(que)定(ding);明確(que)了地方能源(yuan)主管部門是接(jie)入系(xi)統設計的(de)責(ze)任主體,委托具有資質(zhi)的(de)第(di)三方咨詢機構(gou)組織(zhi)評審論(lun)證(zheng),充分聽取(qu)電(dian)網企(qi)業(ye)(ye)意(yi)見,協調確(que)定(ding)接(jie)入系(xi)統意(yi)見。
進一步規范了投資建設與運營
《通知》第四(si)部分圍繞解決(jue)增(zeng)量配電(dian)業(ye)務(wu)建設和運營存在的問題,提出十三條政策措施(shi),從三個(ge)層次展開。
立足解(jie)決共性問(wen)題。目(mu)(mu)前三批320個(ge)試點大部分處(chu)于規劃編制、業主(zhu)選擇、許可證辦理等(deng)階段,投產運營(ying)項(xiang)目(mu)(mu)偏(pian)少。相關部門在(zai)(zai)組織電力規劃設(she)計總院(yuan)等(deng)咨(zi)詢機構全面(mian)摸底(di)調研發現,試點項(xiang)目(mu)(mu)在(zai)(zai)建設(she)、運營(ying)環(huan)節存(cun)在(zai)(zai)的問(wen)題相似,主(zhu)要集中在(zai)(zai)資(zi)產處(chu)置、公網(wang)接(jie)入、電力業務許可證辦理、公平競爭等(deng)方面(mian)。
《通知》第四部分(fen)針對(dui)(dui)這些共性問(wen)題(ti),一(yi)(yi)是(shi)進(jin)一(yi)(yi)步(bu)(bu)重(zhong)申了規劃范圍(wei)內存(cun)量(liang)(liang)資(zi)(zi)產(chan)處置(zhi)方式(shi),鼓勵存(cun)量(liang)(liang)資(zi)(zi)產(chan)通過資(zi)(zi)產(chan)入股、出售、產(chan)權置(zhi)換等方式(shi)參(can)與(yu)(yu)增(zeng)量(liang)(liang)配(pei)(pei)電(dian)(dian)(dian)(dian)網(wang)投資(zi)(zi)、建(jian)設和(he)(he)(he)運(yun)營;二是(shi)進(jin)一(yi)(yi)步(bu)(bu)要求地(di)方有關(guan)部門(men)優化項(xiang)目核(he)準程序,提高(gao)審核(he)效率,加快增(zeng)量(liang)(liang)配(pei)(pei)電(dian)(dian)(dian)(dian)網(wang)建(jian)設核(he)準,要求國(guo)家能(neng)源(yuan)局資(zi)(zi)質中心、派(pai)出能(neng)源(yuan)監管機構進(jin)一(yi)(yi)步(bu)(bu)簡(jian)化增(zeng)量(liang)(liang)配(pei)(pei)電(dian)(dian)(dian)(dian)業務電(dian)(dian)(dian)(dian)力業務許可(ke)證申領程序;三是(shi)明確和(he)(he)(he)強調增(zeng)量(liang)(liang)配(pei)(pei)電(dian)(dian)(dian)(dian)網(wang)與(yu)(yu)大電(dian)(dian)(dian)(dian)網(wang)是(shi)網(wang)對(dui)(dui)網(wang)關(guan)系(xi),擁有與(yu)(yu)電(dian)(dian)(dian)(dian)網(wang)企(qi)業在互聯互通、建(jian)設運(yun)營、參(can)與(yu)(yu)電(dian)(dian)(dian)(dian)力市場、保(bao)底供(gong)電(dian)(dian)(dian)(dian)等方面同(tong)等的(de)權利和(he)(he)(he)義務,進(jin)一(yi)(yi)步(bu)(bu)破除增(zeng)量(liang)(liang)配(pei)(pei)電(dian)(dian)(dian)(dian)網(wang)接入電(dian)(dian)(dian)(dian)網(wang)的(de)體制藩籬(li);四是(shi)建(jian)立(li)國(guo)家和(he)(he)(he)地(di)方政府(fu)有關(guan)部門(men)的(de)互動、聯席工作機制,常態化開展(zhan)對(dui)(dui)增(zeng)量(liang)(liang)配(pei)(pei)電(dian)(dian)(dian)(dian)業務進(jin)展(zhan)緩(huan)慢(man)和(he)(he)(he)問(wen)題(ti)突出地(di)區進(jin)行通報、約談(tan),不斷破解改革(ge)推進(jin)中的(de)難(nan)點問(wen)題(ti)。
切實(shi)保障電(dian)(dian)(dian)(dian)(dian)力(li)安全穩(wen)定供(gong)(gong)(gong)應。避免供(gong)(gong)(gong)電(dian)(dian)(dian)(dian)(dian)事故是增(zeng)量(liang)配(pei)電(dian)(dian)(dian)(dian)(dian)改(gai)革的基本遵循,也(ye)是關(guan)系改(gai)革能否行穩(wen)致遠的關(guan)鍵一(yi)環。《通知(zhi)》第四(si)部分,一(yi)是建(jian)立(li)了增(zeng)量(liang)配(pei)電(dian)(dian)(dian)(dian)(dian)網建(jian)設(she)過渡期(qi)電(dian)(dian)(dian)(dian)(dian)力(li)保障供(gong)(gong)(gong)應方(fang)案,允許由電(dian)(dian)(dian)(dian)(dian)網企(qi)業(ye)(ye)等先行建(jian)設(she)運行配(pei)電(dian)(dian)(dian)(dian)(dian)設(she)施,待增(zeng)量(liang)配(pei)電(dian)(dian)(dian)(dian)(dian)項(xiang)(xiang)目具(ju)備供(gong)(gong)(gong)電(dian)(dian)(dian)(dian)(dian)能力(li)后(hou),可(ke)選擇折價入股或(huo)(huo)轉讓等方(fang)式進行處(chu)置;二是建(jian)立(li)增(zeng)量(liang)配(pei)電(dian)(dian)(dian)(dian)(dian)業(ye)(ye)務試(shi)(shi)點(dian)項(xiang)(xiang)目和項(xiang)(xiang)目業(ye)(ye)主的退出機制,經地方(fang)能源主管部門會同(tong)派出能源監管機構(gou)評估認(ren)定不再具(ju)備試(shi)(shi)點(dian)條件的,報國(guo)家發改(gai)委、國(guo)家能源局同(tong)意后(hou)可(ke)取消項(xiang)(xiang)目試(shi)(shi)點(dian)資格。對于項(xiang)(xiang)目業(ye)(ye)主拖延建(jian)設(she)、拒不履行建(jian)設(she)承諾或(huo)(huo)運營水(shui)平達不到投標要(yao)求,造成無(wu)法(fa)滿足區內(nei)用戶用電(dian)(dian)(dian)(dian)(dian)需求的,應視情況依法(fa)依規取消項(xiang)(xiang)目業(ye)(ye)主資格,并重新招(zhao)標確(que)定項(xiang)(xiang)目業(ye)(ye)主。過渡期(qi)間可(ke)由電(dian)(dian)(dian)(dian)(dian)網企(qi)業(ye)(ye)接收并提供(gong)(gong)(gong)保底供(gong)(gong)(gong)電(dian)(dian)(dian)(dian)(dian)服務,不得因增(zeng)量(liang)配(pei)電(dian)(dian)(dian)(dian)(dian)網業(ye)(ye)主更(geng)換(huan)影響電(dian)(dian)(dian)(dian)(dian)力(li)安全、可(ke)靠供(gong)(gong)(gong)應。三是加強對增(zeng)量(liang)配(pei)電(dian)(dian)(dian)(dian)(dian)項(xiang)(xiang)目業(ye)(ye)主履約行為管理,建(jian)立(li)增(zeng)量(liang)配(pei)電(dian)(dian)(dian)(dian)(dian)企(qi)業(ye)(ye)失(shi)信“黑名(ming)單”。
確保試(shi)點(dian)項(xiang)目(mu)健康發展。隨著試(shi)點(dian)項(xiang)目(mu)陸續(xu)建成投(tou)運,可能(neng)出現試(shi)點(dian)項(xiang)目(mu)盈利空間有(you)限、運營(ying)水平不足(zu)等(deng)新的共性問題和難點(dian),對項(xiang)目(mu)長期平穩(wen)運行帶來較大挑戰(zhan)。《通知》第四部分,一是要(yao)求(qiu)增(zeng)量配(pei)電網(wang)企業(ye)應(ying)設計(ji)合理(li)的法(fa)(fa)人治理(li)結(jie)構,獨(du)立(li)作出投(tou)資(zi)決策(ce);二是鼓(gu)勵采用招(zhao)標定(ding)價(jia)法(fa)(fa)、準許收入法(fa)(fa)、最高限價(jia)法(fa)(fa)、標尺(chi)競(jing)爭法(fa)(fa)等(deng)方(fang)法(fa)(fa)核定(ding)獨(du)立(li)配(pei)電價(jia)格,鼓(gu)勵增(zeng)量配(pei)電網(wang)采取靈活(huo)的價(jia)格策(ce)略,探索新的經營(ying)模式(shi),為用戶提供(gong)優(you)質(zhi)、增(zeng)值(zhi)供(gong)電服務。
瞄(miao)準(zhun)問(wen)題(ti)靶向(xiang)施策,凝(ning)聚(ju)共識(shi)砥礪前行。《通知(zhi)》的(de)(de)下發(fa),為各方開展(zhan)增(zeng)量配(pei)電業務改革提供了規范指引,根本(ben)目(mu)的(de)(de)是加快推進(jin)(jin)試點落(luo)地(di)生根,取得(de)實效。《通知(zhi)》的(de)(de)“二次點火”的(de)(de)作用和“轉折點”的(de)(de)意義,值得(de)我們共同期待。筆者相信,隨著政(zheng)策體系的(de)(de)不斷完善、第四批(pi)試點項目(mu)的(de)(de)申報(bao)批(pi)復、改革實踐的(de)(de)深入推進(jin)(jin)、各方的(de)(de)共識(shi)逐步匯聚(ju),增(zeng)量配(pei)電業務改革的(de)(de)新局面(mian)一定會加快形成(cheng)。
