CSPPLAZA光熱發電網訊:國(guo)家(jia)能源(yuan)局日前發布了《關于貫徹落實“放管(guan)(guan)(guan)服”改革精神優化電力(li)業(ye)務許可(ke)(ke)管(guan)(guan)(guan)理(li)有關事(shi)項的通(tong)知》,調整供電類電力(li)業(ye)務許可(ke)(ke)證申請(qing)條件、規(gui)范增量配電業(ye)務許可(ke)(ke)管(guan)(guan)(guan)理(li)、加強(qiang)輸、供(配)電企業(ye)許可(ke)(ke)事(shi)中事(shi)后監管(guan)(guan)(guan)。
規范(fan)增(zeng)量配電(dian)業(ye)(ye)務(wu)許(xu)可(ke)(ke)管理:在供(gong)電(dian)企業(ye)(ye)持有的電(dian)力業(ye)(ye)務(wu)許(xu)可(ke)(ke)證(zheng)(供(gong)電(dian)類)副(fu)本“供(gong)電(dian)營業(ye)(ye)區(qu)覆蓋范(fan)圍”中統一標(biao)注“不含已許(xu)可(ke)(ke)的增(zeng)量配電(dian)業(ye)(ye)務(wu)配電(dian)區(qu)域”。各(ge)派出機(ji)構應(ying)當在本通知印發后及時組織供(gong)電(dian)企業(ye)(ye)集中辦理許(xu)可(ke)(ke)證(zheng)信(xin)息標(biao)注工作(zuo)。
持有電(dian)(dian)(dian)力業(ye)務(wu)許可證(zheng)的增(zeng)(zeng)量配(pei)(pei)電(dian)(dian)(dian)業(ye)務(wu)項(xiang)目業(ye)主(zhu)依(yi)法享有所轄配(pei)(pei)電(dian)(dian)(dian)區域配(pei)(pei)電(dian)(dian)(dian)網(wang)投資(zi)建設及經營管理(li)的權(quan)利。原供(gong)電(dian)(dian)(dian)企業(ye)應當按照《國家(jia)發展(zhan)改(gai)(gai)革委國家(jia)能源局(ju)關于印發<增(zeng)(zeng)量配(pei)(pei)電(dian)(dian)(dian)業(ye)務(wu)配(pei)(pei)電(dian)(dian)(dian)區域劃分實(shi)施辦法(試(shi)行)>的通知》(發改(gai)(gai)能源規〔2018〕424號)要求,妥善處(chu)置(zhi)存量資(zi)產和用(yong)戶,不得在已許可的增(zeng)(zeng)量配(pei)(pei)電(dian)(dian)(dian)區域內發展(zhan)新(xin)用(yong)戶。
派出(chu)機構(gou)向增(zeng)量配電業(ye)務項目業(ye)主作出(chu)的許可決定應同時抄送原供電企業(ye)。

為貫徹落(luo)實“放管(guan)服”改革(ge)精神(shen),充分(fen)發揮電(dian)力業(ye)務許可(ke)制度在落(luo)實國家產業(ye)政策(ce)、規范企業(ye)經(jing)營行為、維護電(dian)力市場秩序、優化營商(shang)環境等方(fang)面的作用(yong),現就(jiu)優化電(dian)力業(ye)務許可(ke)管(guan)理(li)有關事項通知(zhi)如(ru)下。
一、深入推進簡政放權,簡化發電類電力業務許可管理
(一)繼續實施電力業務許可豁免(mian)政策
以(yi)下發電項目不納入(ru)電力業務許(xu)可管理范圍:
1.經能源主管(guan)部門以(yi)備案(核準)等(deng)方式(shi)明確的分布(bu)式(shi)發(fa)電項(xiang)目;
2.單站(zhan)裝(zhuang)機容量6MW(不含)以下的小水(shui)電(dian)站(zhan);
3.項目裝(zhuang)機容量6MW(不含)以下(xia)的太陽能(neng)、風能(neng)、生物質(zhi)能(neng)(含垃圾(ji)發(fa)(fa)電(dian))、海(hai)洋能(neng)、地熱(re)能(neng)等可再生能(neng)源(yuan)發(fa)(fa)電(dian)項目;
4.項(xiang)目裝機容量6MW(不含)以(yi)下的余熱余壓余氣發電、煤礦(kuang)瓦斯發電等(deng)資源綜合利用項(xiang)目;
5.并網運行的(de)非燃煤(mei)自(zi)備(bei)(bei)電站,以及所發(fa)電量全(quan)部自(zi)用不上(shang)網交易的(de)自(zi)備(bei)(bei)電站。
相關企業(ye)(ye)經(jing)營上述(shu)發(fa)電業(ye)(ye)務不要(yao)求取得發(fa)電類電力(li)業(ye)(ye)務許可證。已(yi)取得電力(li)業(ye)(ye)務許可證的(de),由國家能源(yuan)局各派出機構(gou)公示注(zhu)銷,公示期不少于30日。公示期滿且(qie)無異議的(de),辦理(li)注(zhu)銷手續。各派出機構(gou)要(yao)通過(guo)電網企業(ye)(ye)、調度機構(gou)、交(jiao)易機構(gou)等多種渠道積極聯系有關發(fa)電企業(ye)(ye),做好政策宣傳工(gong)作(zuo)。
(二(er))簡化部分發電企業許可申請要求
除本(ben)通知規定豁免許(xu)可的情形外(wai),經營以下發(fa)電業(ye)務(wu)的企(qi)業(ye),簡化發(fa)電類電力業(ye)務(wu)許(xu)可申請要(yao)求:
1.總裝機容(rong)量50MW及以下(xia)的小(xiao)水電;
2.太陽能(neng)、風能(neng)、生物質(zhi)能(neng)(含垃(la)圾發電(dian))、海洋能(neng)、地熱能(neng)等(deng)可再生能(neng)源發電(dian);
3.余(yu)熱余(yu)壓余(yu)氣(qi)發(fa)(fa)電、煤(mei)礦(kuang)瓦斯(si)發(fa)(fa)電等資源綜合利用(yong)發(fa)(fa)電。
具體簡化內容如下:
主要負責人(ren)(ren)方(fang)面,企業安全負責人(ren)(ren)、生產運行負責人(ren)(ren)、技術負責人(ren)(ren)、財(cai)務負責人(ren)(ren),允許一人(ren)(ren)兼任(ren)多(duo)項職務。
財(cai)務(wu)(wu)資料方面,不(bu)再要求提(ti)供年度(du)財(cai)務(wu)(wu)報告、財(cai)務(wu)(wu)狀況審計(ji)報告,提(ti)供資產負債表即可。
二、貫徹落實供給側結構性改革要求,嚴把許可準入關
(一)明確發電(dian)項目許可要(yao)求(qiu)
除豁免情(qing)形外,發(fa)(fa)(fa)電(dian)(dian)(dian)(dian)項目(mu)應(ying)當在完成啟動試運工作后(hou)3個(ge)月(yue)內(nei)(風電(dian)(dian)(dian)(dian)、光伏發(fa)(fa)(fa)電(dian)(dian)(dian)(dian)項目(mu)應(ying)當在并(bing)網(wang)后(hou)6個(ge)月(yue)內(nei))取得電(dian)(dian)(dian)(dian)力(li)(li)業(ye)務許(xu)可(ke)證。在此規(gui)定(ding)時(shi)限之前,發(fa)(fa)(fa)電(dian)(dian)(dian)(dian)企業(ye)與電(dian)(dian)(dian)(dian)網(wang)企業(ye)簽(qian)訂(ding)《并(bing)網(wang)調(diao)度(du)協議(yi)》《購售電(dian)(dian)(dian)(dian)合同》可(ke)暫不提供電(dian)(dian)(dian)(dian)力(li)(li)業(ye)務許(xu)可(ke)證。發(fa)(fa)(fa)電(dian)(dian)(dian)(dian)企業(ye)取得電(dian)(dian)(dian)(dian)力(li)(li)業(ye)務許(xu)可(ke)證后(hou),應(ying)將有(you)關(guan)許(xu)可(ke)內(nei)容及時(shi)告知相關(guan)電(dian)(dian)(dian)(dian)網(wang)企業(ye)及調(diao)度(du)機(ji)構。超過規(gui)定(ding)時(shi)限仍未(wei)取得電(dian)(dian)(dian)(dian)力(li)(li)業(ye)務許(xu)可(ke)證的,有(you)關(guan)機(ji)組不得繼(ji)續發(fa)(fa)(fa)電(dian)(dian)(dian)(dian)上網(wang)。
(二)優(you)化風電(dian)(dian)、光伏發(fa)電(dian)(dian)項目(mu)許可準(zhun)入監管
風電(dian)和光伏(fu)發電(dian)項(xiang)目應當嚴(yan)格按(an)照規定時限取得(de)電(dian)力業(ye)務許(xu)可證(zheng),分批(pi)投產的(de)風電(dian)或光伏(fu)發電(dian)項(xiang)目,可分批(pi)申請許(xu)可。企(qi)業(ye)應提供機(ji)組(zu)通(tong)過啟動驗(yan)收的(de)證(zheng)明(ming)材(cai)(cai)料或質(zhi)量(liang)監督(du)機(ji)構(gou)出具的(de)《工程質(zhi)量(liang)監督(du)檢查并(bing)網(wang)通(tong)知書》作為發電(dian)設施(shi)具備發電(dian)運行能力的(de)證(zheng)明(ming)材(cai)(cai)料。
對未按要(yao)求取得電(dian)(dian)力業務許可證(zheng)的風電(dian)(dian)、光伏發(fa)電(dian)(dian)企(qi)業,派出機構要(yao)依法予以(yi)處理。對不執(zhi)行(xing)相關(guan)要(yao)求,不配合(he)監(jian)管工作的相關(guan)電(dian)(dian)網企(qi)業,給予通報批評(ping),拒不整改的,依法予以(yi)處理。
(三(san))做好煤(mei)電(dian)機組市場退出(chu),促進淘汰落后產能(neng)
按照《國(guo)家發展改(gai)(gai)革委國(guo)家能(neng)源(yuan)(yuan)(yuan)局關(guan)(guan)于深入推(tui)進供給側(ce)結構性改(gai)(gai)革進一步(bu)淘(tao)汰煤(mei)(mei)電(dian)(dian)落后(hou)產能(neng)促進煤(mei)(mei)電(dian)(dian)行業(ye)優化升級的(de)(de)意(yi)見》(發改(gai)(gai)能(neng)源(yuan)(yuan)(yuan)〔2019〕431號(hao))精神,對于列入淘(tao)汰關(guan)(guan)停(ting)(ting)計劃的(de)(de)煤(mei)(mei)電(dian)(dian)機(ji)組(應(ying)急備(bei)用電(dian)(dian)源(yuan)(yuan)(yuan)除外(wai)),派出機(ji)構應(ying)按照各(ge)省(區(qu)、市)人民政府制定的(de)(de)落后(hou)煤(mei)(mei)電(dian)(dian)機(ji)組關(guan)(guan)停(ting)(ting)方案和(he)年度關(guan)(guan)停(ting)(ting)計劃明確(que)的(de)(de)時限,督促企業(ye)辦(ban)理許(xu)可(ke)(ke)證變(bian)更(geng)或(huo)(huo)注銷(xiao)手(shou)續。經(jing)地方能(neng)源(yuan)(yuan)(yuan)主(zhu)管部門確(que)認已實際關(guan)(guan)停(ting)(ting)的(de)(de)項目,按規定變(bian)更(geng)或(huo)(huo)注銷(xiao)電(dian)(dian)力業(ye)務(wu)許(xu)可(ke)(ke)證。煤(mei)(mei)電(dian)(dian)應(ying)急備(bei)用電(dian)(dian)源(yuan)(yuan)(yuan)關(guan)(guan)停(ting)(ting)后(hou)應(ying)及時變(bian)更(geng)或(huo)(huo)注銷(xiao)電(dian)(dian)力業(ye)務(wu)許(xu)可(ke)(ke)證。
關停機組(zu)發(fa)電權轉(zhuan)讓不需要保(bao)留電力業務許可。
三、規范許可管理,加強事中事后監管
(一)調整供(gong)電(dian)類(lei)電(dian)力業(ye)務許可(ke)證申請條件(jian)
根據(ju)《國務院關于取消(xiao)和下放50項(xiang)(xiang)行(xing)政審批(pi)項(xiang)(xiang)目等(deng)事項(xiang)(xiang)的(de)決定》(國發〔2013〕27號),將(jiang)電力業(ye)務許可證(供(gong)電類)申請條件中“具(ju)有(you)經有(you)關主管(guan)部門批(pi)準的(de)供(gong)電營業(ye)區(qu)”調(diao)整(zheng)為(wei)“具(ju)有(you)有(you)關主管(guan)部門出(chu)具(ju)的(de)供(gong)(配(pei))電區(qu)域劃(hua)分(fen)意見或企業(ye)間自(zi)主達成的(de)供(gong)(配(pei))電區(qu)域劃(hua)分(fen)協(xie)議(yi)”。
(二(er))規范增量(liang)配電業務許可管理
在(zai)供(gong)電企(qi)業(ye)持有(you)的電力業(ye)務許可證(供(gong)電類)副本(ben)“供(gong)電營業(ye)區覆蓋范圍”中統(tong)一(yi)標注“不(bu)含已(yi)許可的增量配(pei)電業(ye)務配(pei)電區域”。各派出機(ji)構應當在(zai)本(ben)通知(zhi)印發后及時組織供(gong)電企(qi)業(ye)集中辦理許可證信息標注工作(zuo)。
持有電(dian)(dian)力(li)業(ye)務(wu)許可證的增(zeng)量(liang)配(pei)電(dian)(dian)業(ye)務(wu)項目業(ye)主依法(fa)享有所轄配(pei)電(dian)(dian)區(qu)域(yu)配(pei)電(dian)(dian)網投資建(jian)設及經營管理的權利(li)。原供電(dian)(dian)企業(ye)應當(dang)按照(zhao)《國家(jia)發展改革委國家(jia)能源局(ju)關于印發<增(zeng)量(liang)配(pei)電(dian)(dian)業(ye)務(wu)配(pei)電(dian)(dian)區(qu)域(yu)劃分實施辦法(fa)(試行)>的通知》(發改能源規(gui)〔2018〕424號)要(yao)求(qiu),妥善(shan)處置(zhi)存量(liang)資產和用戶,不得在已許可的增(zeng)量(liang)配(pei)電(dian)(dian)區(qu)域(yu)內發展新用戶。
派(pai)出機構向增量配電業(ye)務(wu)項目業(ye)主作出的(de)許可(ke)決定應同時抄送原供電企業(ye)。
(三)加強(qiang)輸、供(配)電企(qi)業許可(ke)事中事后(hou)監管
持有電(dian)(dian)(dian)力業(ye)(ye)務(wu)許(xu)(xu)可(ke)證(zheng)的輸(shu)、供(gong)(gong)(配(pei)(pei))電(dian)(dian)(dian)企(qi)(qi)業(ye)(ye)應(ying)當(dang)嚴格履行持證(zheng)企(qi)(qi)業(ye)(ye)義務(wu),按照有關規定開展定期自查、申(shen)請許(xu)(xu)可(ke)變(bian)(bian)(bian)更。輸(shu)電(dian)(dian)(dian)企(qi)(qi)業(ye)(ye)主(zhu)(zhu)網(wang)架輸(shu)電(dian)(dian)(dian)設(she)施(shi)投入(ru)運(yun)營(ying)、終止(zhi)運(yun)營(ying)的,應(ying)于每年二季度(du)(du)集中(zhong)(zhong)向所在(zai)地(di)派出機構申(shen)請辦理上一年度(du)(du)此類許(xu)(xu)可(ke)事(shi)項(xiang)變(bian)(bian)(bian)更。供(gong)(gong)(配(pei)(pei))電(dian)(dian)(dian)企(qi)(qi)業(ye)(ye)供(gong)(gong)(配(pei)(pei))電(dian)(dian)(dian)設(she)施(shi)投入(ru)運(yun)營(ying)、終止(zhi)運(yun)營(ying)的,不列入(ru)許(xu)(xu)可(ke)事(shi)項(xiang)變(bian)(bian)(bian)更,按照登記事(shi)項(xiang)變(bian)(bian)(bian)更管理。供(gong)(gong)(配(pei)(pei))電(dian)(dian)(dian)企(qi)(qi)業(ye)(ye)應(ying)于每年二季度(du)(du)集中(zhong)(zhong)向所在(zai)地(di)派出機構報送主(zhu)(zhu)要設(she)施(shi)、設(she)備變(bian)(bian)(bian)化情況并辦理變(bian)(bian)(bian)更手續(xu)。供(gong)(gong)(配(pei)(pei))電(dian)(dian)(dian)企(qi)(qi)業(ye)(ye)供(gong)(gong)(配(pei)(pei))電(dian)(dian)(dian)區域發生變(bian)(bian)(bian)化的,應(ying)及時申(shen)請許(xu)(xu)可(ke)事(shi)項(xiang)變(bian)(bian)(bian)更。
各(ge)派出機構要落實“一網通辦(ban)(ban)(ban)”要求,企業(ye)(ye)自查、變更(geng)等業(ye)(ye)務全部實現網上辦(ban)(ban)(ban)理,做到辦(ban)(ban)(ban)理事項、辦(ban)(ban)(ban)理流程和辦(ban)(ban)(ban)理結果公(gong)開(kai)、透(tou)明。
各(ge)派出機(ji)構應(ying)按照(zhao)國家關(guan)于加(jia)快(kuai)構建以信(xin)用(yong)為基礎的新型監(jian)(jian)管(guan)機(ji)制要求,依(yi)法組織實施持證(zheng)企業信(xin)用(yong)監(jian)(jian)管(guan),與“雙隨機(ji)、一(yi)公開”監(jian)(jian)管(guan)相結合(he),采取差異化監(jian)(jian)管(guan)措(cuo)施,不斷提升信(xin)用(yong)監(jian)(jian)管(guan)效能(neng)。
本(ben)通知自印(yin)發之日起(qi)施行。《國(guo)(guo)家能(neng)(neng)源(yuan)局關于(yu)明確電(dian)力(li)業(ye)務許可管(guan)理有關事項的(de)通知》(國(guo)(guo)能(neng)(neng)資(zi)質〔2014〕151號(hao)(hao))、《國(guo)(guo)家能(neng)(neng)源(yuan)局綜合司關于(yu)落實電(dian)力(li)業(ye)務許可管(guan)理有關事項的(de)通知》(國(guo)(guo)能(neng)(neng)綜資(zi)質〔2014〕426號(hao)(hao))同時廢止。
